Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of this website (“Site”), including the purchase of products and services offered through it. The Site is operated and distributed by Nippon Cha FZE, located in the United Arab Emirates, trading under the brand name AiCha.

Although the AiCha name and visual identity are not yet registered trademarks, all brand elements including the name, logo, design system, and content, are protected under intellectual property and unfair competition laws applicable in the UAE and internationally.

By using or accessing this Site, you (“User”, “you”, “your”) agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, please refrain from using the Site or placing any orders.

1. Ordering and Payment
All orders placed on the Site must be paid in full at checkout. Payments are processed securely through XXXXX and may be made using Visa, Mastercard, Apple Pay, or Google Pay. These payment processors include advanced encryption and fraud-prevention mechanisms to ensure transaction safety.

Prices are shown in the currencies relevant to your shipping destination, such as AED, USD, EUR, JPY, or others. An order is considered confirmed only after successful payment authorization. AiCha reserves the right to reject, suspend, or cancel any order at its sole discretion, including in cases of suspected fraud, pricing or system errors, or violation of these Terms.


2. Shipping and Delivery
AiCha ships to a wide range of international destinations, including but not limited to: Austria, Bahrain, Belgium, Canada, France, Germany, Japan, Kuwait, Malaysia, Oman, Saudi Arabia, Singapore, the United Arab Emirates, the United States, and others listed on our Shipping Policy page.

All delivery rates, timeframes, and service options are detailed in the Shipping Policy, which forms part of these Terms by reference. Risk of loss or damage to goods transfers to the customer only upon confirmed delivery. AiCha ships orders in a single consolidated package; partial shipments are not available.


3. Returns and Refunds
Returns and refunds follow our Refund Policy, which is incorporated into these Terms. Generally, returns are only accepted for damaged or defective teaware. We do not offer product exchanges. Refunds are issued to the original payment method used at checkout, and customers are responsible for return shipping costs unless otherwise specified.


4. Promotions and Offers
AiCha may from time to time run promotional campaigns or offers, which may include:

  • Welcome discounts for first-time customers;
  • Free shipping or gifts for orders above a certain threshold;
  • Seasonal or event-based percentage discounts;
  • Discount codes shared via newsletters or official communications.

Each promotion may carry specific terms such as minimum order amounts, product exclusions, or limits per user. Unless otherwise stated, promotions cannot be combined.

If a product purchased under a promotion is returned, the refund amount will reflect the price actually paid after the applied discount. Complimentary gifts may be retained by the customer. AiCha reserves the right to modify, limit, or withdraw promotional benefits in the event of misuse, fraud, or abuse.

Gift cards, where offered, are valid for 12 months from the date of purchase. Store credits do not expire.

5. Intellectual Property and Brand Protection
All materials on this Site, including text, photography, graphics, logos, packaging design, and digital assets, are the intellectual property of Nippon Cha FZE or its licensors.
You may not, without prior written consent:

  • Reproduce, modify, distribute, or republish Site content in whole or in part;
  • Use AiCha’s name, visuals, or product photography for any commercial or competitive purpose;
  • Scrape or systematically collect data such as product names, prices, or descriptions;
  • Frame, deep-link, or replicate any portion of the Site.

Even though AiCha is not yet a registered trademark, all brand assets are actively protected as proprietary elements of Nippon Cha FZE, and unauthorized use may result in legal action under applicable intellectual property and trade laws.
If you submit any content to AiCha (including reviews, photos, or testimonials), you grant us a perpetual, royalty-free, worldwide license to use, reproduce, and distribute that content across media channels.

6. Acceptable Use
You agree to use the Site responsibly and only for lawful purposes. You may not:

  • Violate local or international laws;
  • Infringe upon the rights of others;
  • Attempt to damage, disable, or compromise the Site or its systems;
  • Deploy malicious code, scraping tools, or bots;
  • Resell AiCha products without express written authorization from Nippon Cha FZE.

AiCha reserves the right to limit or terminate your access, suspend your account, or cancel orders in the event of unlawful or abusive activity.

7. Limitation of Liability
To the fullest extent permitted under UAE law, Nippon Cha FZE are not liable for:

  • Indirect, incidental, or consequential damages;
  • Website downtime, delays, or technical failures;
  • Losses caused by third-party websites or external links.

Our total liability, in any circumstance, shall not exceed the total value paid for the order giving rise to the claim. This clause does not limit liability for death, personal injury, or any other liability that cannot be lawfully excluded.

8. Indemnification
You agree to indemnify and hold harmless Nippon Cha FZE, its employees, directors, affiliates, and partners from all claims, damages, losses, or costs (including legal fees) arising from:

  • Violation of these Terms;
  • Breach of applicable laws;
  • Misuse of the Site or its content.

9. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates. Any dispute arising from or related to these Terms shall fall under the exclusive jurisdiction of the Dubai and Sharjah courts. Consumer protection laws of the UAE apply as required by regulation.


10. Definitions
For clarity:

  • Product refers to any physical or digital goods offered through the Site, including tea, teaware, accessories, gift cards, or credits.
  • Service refers to any experience, workshop, or class organized by AiCha.
  • Agreement means the legal relationship established by your acceptance of these Terms.
  • The owner refers to Nippon Cha FZE, operator and distributor of AiCha products.
  • User means any visitor, customer, or participant using the Site.

AiCha reserves the right to amend these Terms at any time. Updated versions will be published on the Site with a revised effective date. Continued use of the Site after such updates constitutes acceptance of the modified Terms.

If any provision of these Terms is deemed unenforceable, the remaining provisions shall continue in effect and enforceability.
